The Case
The plaintiff, a 58-year-old construction worker, slipped and fell on scattered BX cable and debris on the floor of a small unit where he had been working at a construction site. He sustained serious injuries requiring extensive treatment and surgery to the right knee and lumbar spine.
The Challenge
The accident was unwitnessed and not reported until a few days after the accident. The defense also tried using the age of the plaintiff and long history of construction work to argue that the injuries were pre-existing and degenerative rather than causally related to the fall.
The Result
Despite these compounding vulnerabilities, counsel secured a $3,050,000 settlement, a result that reflects meticulous development of the medical proof and the strength of the Labor Law § 241(6) claim.
