The Case
The plaintiff was operating a motor vehicle when she was struck by the defendants' vehicle in the middle of an intersection controlled by traffic lights. She sustained injuries to the knee, neck and back.
The Challenge
Liability was a pure question of credibility: the plaintiff maintained that the defendant ran the red light, while the defense claimed the opposite. On damages, the defense argued that the cervical and lumbar procedures were minimally invasive pain management interventions rather than major surgeries, and pointed to the plaintiff's minimal lost time from work.
The Result
Despite a sharply disputed he-said-she-said liability picture and a defense narrative aimed at devaluing the injuries, counsel secured a $1,000,000 settlement.
