How Lyft Accident Claims Work in White Plains
New York is a no-fault state, so your Personal Injury Protection (PIP) benefits typically cover initial medical costs and part of your lost wages, regardless of fault.
If you meet the “serious injury” threshold under state law, you can pursue a liability claim against the at-fault party for pain and suffering and other losses not covered by PIP.
Lyft claims involve layered insurance. Coverage depends on whether the driver was offline, available and waiting for a ride request, or actively picking up or transporting a passenger. When a ride is accepted or in progress, Lyft carries a significant third-party liability policy that can apply.
Because facts change quickly, early investigation matters. Our personal injury lawyers in White Plains identify all available policies, confirm the driver’s app status, and align your claim with New York law.
Proving Fault and Building Your Injury Case
Liability in a rideshare crash follows the same legal standards as any other car accident case in New York. We must show duty, breach, causation, and damages. That proof comes from careful documentation and witness-driven facts, not guesswork.
Evidence We Use To Prove Liability
We gather crash reports, driver statements, and witness accounts. We review photos, video, dashcam footage, app metadata confirming the driver’s status, and vehicle telematics when available. We also analyze points of impact, road design, and visibility to connect conduct with injuries.
Medical records, billing histories, and expert opinions link the collision to your condition. When disputes arise, we may retain accident reconstructionists or vocational and economic experts to support future loss claims.
Damages You Can Recover After a Rideshare Collision
Your recovery includes both economic and non-economic losses. PIP can address early medical bills and a portion of lost wages, while a liability claim can cover the broader impact of the crash.
In a qualifying lawsuit, you may seek medical expenses, future treatment, lost income, diminished earning capacity, and property losses. You may also claim pain and suffering, loss of enjoyment of life, and related harms tied to permanent injuries.
Our White Plains Lyft accident attorneys match each category of damages to evidence. That linkage persuades insurers—and, if needed, a jury—that your losses are real, documented, and compensable.
How We Handle Rideshare Injury Claims
We begin with a detailed intake and a free case evaluation. Then we secure evidence, confirm the driver’s app status, and identify all policies. We handle no-fault forms, coordinate benefits, and pursue liability claims for the full measure of your losses.
Insurers contest fault and value, especially when pain and suffering is at stake. We prepare every file as if it could go to trial. That preparation supports strong negotiations and gives you options if the carrier won’t be fair.
You’ll always know where your case stands. We return calls, explain each step, and make sure you can focus on healing while we do the legal work.
