Why Choose Shulman & Hill After a Bike Crash
You need a team that knows cycling cases and the local roads. We have handled claims involving intersections like Mamaroneck Avenue and Post Road, multi-lane corridors, and neighborhood streets where dooring and right-hook crashes occur.
We move fast to secure video, witness statements, and scene data while you focus on treatment. Our approach is tailored to bicycle dynamics, visibility issues, and driver behavior that often lead to severe injuries.
From day one, we explain your options, potential timelines, and the value drivers and insurers place on certain fact patterns. Our clear communication helps you make informed choices about settlement or trial.
What to Do After a Bicycle Accident in White Plains
Your steps in the first days can shape your claim. Always prioritize safety and medical care, even if pain seems minor at first, because symptoms often worsen in the days following a crash.
If you can, collect information from the driver and any witnesses, and take photos of vehicles, your bike, your injuries, and the roadway. Keep all damaged gear and clothing; they can help prove impact forces and angles.
- Get immediate medical evaluation and follow your treatment plan
- Call the police and request the MV-104 report number
- Photograph the scene, vehicles, bike damage, and injuries
- Gather driver, witness, and insurance details
- Preserve your helmet, bike, and clothing without repairs or washing
- Avoid recorded statements to insurers until you have legal guidance
Proving Fault and Preserving Evidence
Winning a bicycle claim often turns on fast, thorough evidence work. We look for traffic camera footage, dashcam files, storefront videos, and telematics before these records are routinely deleted. We also inspect road conditions, lighting, and sightlines that affect a driver’s ability to see a cyclist.
We review the police report, but evidence collection doesn’t stop there. Skid marks, debris fields, broken glass, and gouges can show impact location and speed. We frequently consult with accident reconstruction professionals to model turns, braking distances, and line-of-sight.
Digital Evidence From Devices
Phones, watches, fitness apps, e-bikes, and vehicles may all store valuable data. Strava or Garmin can show speed and path. Vehicle event data recorders can reflect braking or throttle. Our White Plains bicycle accident lawyers send preservation letters quickly to keep this information from being lost.
How New York Negligence Laws Affect Your Claim
New York applies pure comparative negligence. If a driver claims you were partially at fault—say, for not using a hand signal or choosing a particular lane—you can still recover money, but your payout may be reduced by your share of fault. We focus on driver conduct such as speeding, failure to yield, unsafe passing, or dooring to counter those claims.
Bicycles have the same right to the road as motor vehicles except where prohibited. That includes the right to take the lane when necessary for safety. We frame the case around those rights and the specific vehicle and traffic law duties drivers owe to cyclists at intersections, driveways, and when opening doors.
Helmet use does not bar recovery in New York. Insurers sometimes hint at that argument, but the law does not allow a reduction for failing to wear a helmet in adult cases. We keep the spotlight on the driver’s conduct and the crash mechanics.
Statute of Limitations and Deadlines in New York
Most personal injury lawsuits must be filed within three years of the crash date. Wrongful death cases generally have a two-year window. Missing a deadline can end your claim, even if liability is strong.
Claims against a public entity, such as a municipality responsible for a dangerous roadway, involve shorter notice requirements—often 90 days to file a Notice of Claim. We identify all potential defendants early to protect your rights.
Medical treatment timelines matter too. Prompt care creates a clear link between the crash and your injuries. Gaps in treatment give insurers arguments they can use to discount your case.
Recoverable Compensation for Injured Cyclists
Serious injuries change your routine, income, and independence. We build damages from the ground up, tallying medical bills and projecting future care for surgeries, therapy, or assistive devices. We also document reduced earning capacity if lingering symptoms limit your hours or job duties.
Pain and suffering damages include the loss of activities you value—riding, commuting, or spending time with family without constant pain. We encourage you to keep a recovery journal that captures sleep disruption, missed events, and day-to-day limitations.
Property damage recovery can extend to your bike, helmet, lights, GPS, and clothing. We use shop estimates and comparable sales to establish value, whether it’s a carbon frame or a commuter setup. When parts are backordered or discontinued, we address fair replacement costs.
Dealing With Insurance Companies After a Crash
New York’s No-Fault benefits may help with medical costs and a portion of lost wages, even if you were on a bicycle and struck by a motor vehicle. We will coordinate No-Fault coverage with any health insurance to reduce your out-of-pocket expenses and keep your claim on track.
When liability coverage is insufficient, or the driver fled, uninsured/underinsured motorist coverage from your own auto policy may apply. Many cyclists do not realize they are covered this way. We review your policies to find every available dollar.
You may also be able to sue the at-fault party if your injury costs exceed No-Fault thresholds or you have a serious injury. We will investigate your case from all angles to identify sources of redress for your losses.
White Plains Routes, Road Hazards, and Local Factors
Local conditions matter. Intersections with limited sightlines, parked-car corridors that invite dooring, and construction zones can all increase risk. We often document signage, pavement markings, and vegetation that obscure views or confuse drivers.
Snow piles and seasonal potholes also play a role. After storms, narrowed lanes push vehicles closer to cyclists. Timely photos help capture these changing conditions before they disappear.
We consider city planning documents, prior crash data, and maintenance records when a roadway defect or design adds to the danger. If a public entity or contractor played a part, we preserve those claims promptly.
Hiring a Lawyer in White Plains: Fees and Process
We work on a contingency fee, which means no upfront payment and no legal fee unless we recover compensation for you. During your free consultation, we discuss case strengths, possible challenges, and key milestones.
If you hire us, we will notify insurers, gather medical records, and launch a targeted investigation. We keep you updated with plain-language summaries and set realistic expectations about timelines and settlement ranges.
Most cases resolve through negotiation, but we prepare every file as if it will be tried. Detailed preparation improves settlement leverage and helps a jury understand your story if a trial becomes necessary.
