Understanding How Lyft Claims Work
Lyft claims involve two layers: New York’s no-fault (PIP) benefits and liability coverage when someone else is at fault. Your own PIP generally pays initial medical expenses and a portion of lost wages, regardless of fault.
If you meet New York’s “serious injury” threshold or another driver is liable, you may pursue a bodily injury claim. When a Lyft driver is involved, the app status at the time of the crash affects which liability policy applies and how much coverage is available.
A personal injury lawyer in Greenburgh can review the details of your accident, explain which insurance policies may apply, and help you understand your legal options.
Who Is Liable When a Rideshare Crash Happens
Liability depends on who acted carelessly. The at-fault party could be a Lyft driver, another motorist, or a combination of several drivers. In some cases, a vehicle owner or an employer can also share responsibility.
New York follows pure comparative fault. If you are found partially at fault, your award can be reduced by your percentage of fault, but you can still recover the remaining portion. We focus on collecting evidence early to keep blame from shifting unfairly onto you.
Insurance Coverage in Lyft Collisions in Greenburgh
The active Lyft app status controls the available liability limits. If the Lyft driver is off the app, the driver’s personal auto policy applies. If the driver is online and waiting for a ride request, a contingent policy with lower limits can apply. If the driver is en route to pick up a passenger or transporting one, a higher commercial policy is usually in play.
Even when the right coverage exists, insurers may dispute fault, causation, or the nature of your injuries. Our Lyft accident lawyers in Greenburgh can present medical documentation, crash reconstruction, and witness statements to connect the dots between the crash and your losses.
When App Status Changes the Policy
App records, GPS data, and trip logs often settle questions about whether the driver was available for rides, on the way to a pickup, or carrying a passenger.
We can secure this digital evidence quickly to prevent gaps. If an insurer challenges the driver’s status, we pursue Lyft’s records and the driver’s phone data to protect your claim.
What To Do After a Crash in Greenburgh
Your steps in the first hours and days can shape the claim. Safety comes first, followed closely by documentation. If you are physically able, gather details before vehicles leave the scene.
Consider the following steps:
- Call 911 and request a police report with the rideshare noted.
- Seek prompt medical care and follow the treatment plan.
- Capture photos and videos of vehicles, damage, and the scene.
- Collect driver, passenger, and witness contact details.
- Save the Lyft trip receipt and app screenshots.
These steps help verify liability and damages. If you could not complete them at the scene, we can help fill in the gaps through records, surveillance, and professional analysis.
Lyft Accident Damages We Pursue
We calculate damages that reflect your real-world losses, not just initial bills. Economic losses can include medical treatment, future care, lost wages, and reduced earning capacity. We also pursue non-economic losses like pain, limitations, and loss of enjoyment of life.
If a family member was lost in a Lyft crash, we pursue wrongful death damages allowed under New York law. In every case, we align medical evidence, wage records, and opinions by qualified professionals to support the value of your claim.
Time Limits and Filing Deadlines
New York has strict deadlines. Many injury lawsuits must be filed within three years, while wrongful death claims generally have shorter windows. No-fault applications are also time-sensitive and must be filed quickly to preserve benefits.
Claims against municipal entities may require a Notice of Claim within 90 days. We confirm the correct timetable for your situation, track each deadline, and file on time.
How Our Greenburgh Lyft Accident Lawyers Build Your Case
From day one, we lock down evidence: police reports, traffic camera footage, dashcam files, app data, black box readings, and medical records. We speak with witnesses early, while details are fresh. Where helpful, we consult collision reconstruction and medical professionals.
We prepare every case as if it may go to trial, even while we pursue a fair settlement. This approach signals that we are ready to present the facts to a jury if needed. Throughout the process, we keep you updated and involved in important decisions.
Common Defenses and How We Respond
Insurers may argue that your injuries were preexisting or that low-speed impact could not cause your symptoms. We counter with imaging, specialist evaluations, and your clean medical history prior to the wreck. If they point to gaps in care, we explain appointment delays or access issues.
Another frequent tactic is disputing the Lyft driver’s app status to avoid higher limits. Our Greenburgh Lyft accident attorneys can obtain trip data and driver logs to confirm when the Lyft platform was active.
