Your Rights After a Rideshare Collision in Greenburgh
New York’s no-fault system generally provides PIP benefits for medical care and a portion of lost wages, regardless of who caused the crash. You also retain the right to pursue a claim against the at‑fault party if your injuries meet the state’s “serious injury” threshold.
You can choose your own doctors, document all treatment, and track out‑of‑pocket costs. If pain and limitations affect your daily life or work, those impacts may be recoverable from the liable party beyond PIP.
If a loved one died in a rideshare crash, your family may bring a wrongful death action for funeral costs, lost financial support, and related harms. Our personal injury lawyer in Greenburgh handles these claims with care and diligence.
Who Is Liable in an Uber Accident?
Fault can rest with multiple parties: the Uber driver, another motorist, a commercial vehicle operator, or a municipality for a hazardous roadway. We examine each angle to find every available insurance policy.
New York follows pure comparative negligence, which means your recovery can be reduced by your share of fault but not barred. Thorough investigation helps prevent insurers from overstating your role in the crash.
In multi-vehicle collisions, we map each driver’s actions using photos, data, black‑box downloads, and witness accounts. This layered approach helps us position your Uber accident claim for fair compensation.
Insurance Coverage in Uber Claims in Greenburgh
Coverage depends on the driver’s app status. If the Uber app was off, the driver’s personal policy applies. If the app was on and the driver was waiting for a ride request, a contingent rideshare policy may activate over the personal policy. Once the driver is matched or transporting a passenger, a high‑limit commercial policy is typically available.
New York also involves no‑fault benefits, which may come from the vehicle you occupied or other applicable policies. We coordinate PIP with bodily injury liability and uninsured/underinsured motorist coverage to avoid gaps.
When multiple coverages overlap, our Greenburgh Uber accident attorneys track benefits and offsets so you aren’t shorted. This includes monitoring medical payments, wage loss, and any liens that may affect your net recovery.
When Uber’s $1 Million Policy Applies
If the driver accepted a trip or you were already in transit, Uber’s high‑limit third‑party liability coverage usually applies. Uninsured/underinsured motorist coverage may also be available if another driver caused the crash but lacks adequate insurance.
Our team confirms app status through driver statements, electronic records, and, when needed, legal process. Getting that status clear early helps direct your claim to the proper insurer.
Evidence That Strengthens Your Case
Strong proof often drives results. Early steps help lock down evidence and guard against disputes over fault and damages.
Helpful evidence includes:
- Photos and videos of vehicles, skid marks, and road conditions.
- Names and contacts for independent witnesses.
- Police reports and any traffic camera or dashcam footage.
- App screenshots showing ride status, time, and route.
- Medical records linking injuries to the crash.
- Pay records, tax returns, and employer letters on lost income.
How We Build Your Claim
Our Uber accident lawyers in Greenburgh start with a focused investigation: scene review, vehicle inspections, data downloads, and interviews. When appropriate, we consult crash reconstruction professionals and medical specialists to support causation and the extent of your injuries.
Next, we document losses: medical treatment plans, future care needs, work restrictions, and the personal impact on your day‑to‑day life. We seek to capture both the immediate and long‑term costs.
We then present a clear demand to the responsible insurer, backed by evidence and legal authority. If the carrier stalls or low‑balls, we file suit and litigate in Westchester County courts to protect your rights.
Damages You Can Pursue After an Uber Accident
Available damages typically include medical bills, rehabilitation, lost wages, and loss of future earning capacity. You may also recover for pain, suffering, and loss of enjoyment of life when the law allows.
Property losses, such as repairs or replacement of a vehicle, phone, or other items, can be included. For serious injuries, home modifications, mobility aids, and extended therapies may be part of the claim.
Families pursuing wrongful death cases can seek funeral and burial costs, lost financial support, and other losses recognized by New York law. We handle these claims with care and respect.
Choosing a Lawyer for an Uber Accident Case
Rideshare cases blend PIP, bodily injury, and UM/UIM coverage with questions about app status and commercial policies. You want a firm that handles car crash litigation, understands rideshare insurance periods, and knows the local courts.
At Shulman & Hill, we focus on building clear, persuasive claims. We work to pursue the full value of your claim under New York law.
We offer contingency arrangements, so legal fees are collected only if we recover money for you. That lets you focus on healing while we press your claim.
