Slip and fall cases can look straightforward on the surface, but they often involve disputed facts, missing evidence, and insurance companies that are quick to assign blame to the victim. Our premises liability lawyers in Scarsdale have recovered over $1 billion for injured New Yorkers across every borough and community.
Why Slip and Fall Cases in New York Are Harder Than They Look
Many slip and fall victims assume that because they were hurt on someone else’s property, compensation is automatic. In reality, New York law requires proving that the property owner knew or should have known about the dangerous condition and failed to address it.
Insurance companies routinely argue that the hazard was open and obvious, that the victim was not paying attention, or that the condition existed for too little time for the owner to have discovered it. These defenses can significantly reduce or eliminate a claim if they are not challenged effectively.
Our personal injury lawyers in Scarsdale understand how these arguments work and how to counter them with evidence. We have handled these cases across New York and know what it takes to hold negligent property owners accountable.
Where Slip and Fall Accidents Commonly Happen in Scarsdale
Slip and fall accidents can occur on virtually any type of property. However, certain locations and conditions account for a disproportionate share of the cases we see in New York.
Common locations and causes of slip and fall accidents include:
- Grocery stores and retail spaces with wet or slippery floors
- Apartment buildings and residential properties with poorly maintained common areas
- Sidewalks and parking lots with ice, snow, or uneven pavement
- Restaurants and hospitality venues with spills or inadequate matting
- Office buildings and public facilities with broken stairs or poor lighting
Regardless of where your accident occurred, the key question is whether the property owner failed to maintain reasonably safe conditions. Our attorneys can evaluate the specific circumstances of your fall and advise you on your options.
Proving Negligence in a New York Slip and Fall Claim
To succeed in a slip and fall claim in New York, you generally need to show that a dangerous condition existed, that the property owner knew or should have known about it, and that the condition directly caused your injuries. Each element requires evidence.
Useful evidence in a slip and fall case may include surveillance footage, incident reports, maintenance logs, photographs of the hazard, and witness statements. Medical records documenting your injuries and their connection to the fall are also critical.
Shulman & Hill conducts in-depth in-house investigations to gather and preserve this evidence as quickly as possible. Surveillance footage can be overwritten within days, and conditions are often repaired shortly after an accident occurs. Acting quickly can make a significant difference in the strength of your claim.

What Your Slip and Fall Claim May Be Worth
The value of a slip and fall claim in New York depends on the severity of your injuries, the impact on your ability to work and live your daily life, and the strength of the evidence supporting your case.
Compensation you may be able to recover includes medical expenses, lost wages, pain and suffering, and costs associated with ongoing treatment or rehabilitation. If your injuries have resulted in a long-term or permanent limitation, future damages may also be available.
New York follows a pure comparative negligence rule, meaning you may still recover compensation even if you were partially at fault for the fall. However, your recovery may be reduced in proportion to your share of fault.
Steps to Take After a Slip and Fall Accident in Scarsdale
What you do in the hours and days after a slip and fall accident can have a meaningful impact on your claim. Taking the right steps early helps preserve evidence and protects your legal rights.
If you are able, take the following steps after a fall:
- Report the accident to the property owner or manager and request a written incident report
- Photograph the hazardous condition, your injuries, and the surrounding area
- Collect contact information from any witnesses who saw the fall
- Seek medical attention promptly, even if your injuries seem minor at first
- Avoid giving recorded statements to insurance adjusters before speaking with an attorney
Contacting a slip and fall accident lawyer in Scarsdale as soon as possible gives your legal team the best opportunity to investigate while evidence is still available.
