The Case
The plaintiff, a plumber's helper, was standing on a gangbox removing a core drill from a concrete wall when the drill fell from the wall and struck his right leg, causing him to lose his balance and fall approximately five feet, striking his back on the concrete floor. He sustained injuries to his lumbar and cervical spine, right knee, and both shoulders, ultimately undergoing a surgery to his back right knee.
The Challenge
The case settled while discovery was still open. The defendants had not yet been deposed, and no defense medical examinations of the plaintiff had been conducted, meaning the result was achieved without the leverage of a completed record or any liability ruling.
The Result
The $1,175,000 settlement delivered a substantial recovery for an injured worker at an early stage of litigation, sparing the client years of additional discovery, motion practice, and trial risk while resolving the case before the defense had built its record.
