The Case
The plaintiff was injured when he fell from an unsecured ladder at a construction project in Suffolk County. Plaintiff sustained injuries to his lower back and knee.
The Challenge
The defense argued that the plaintiff caused his own accident by disregarding a specific instruction to use a safety harness and further argued that plaintiff’s claimed injuries were not caused by the accident but rather were related to a prior injury.
The Result
Plaintiff's counsel defeated the recalcitrant-worker defense and secured summary judgment on liability under Labor Law § 240(1).
