The Case
The plaintiff, a 51-year-old non-union construction worker, slipped and fell on water that had accumulated on a permanent staircase at a construction site. He sustained serious injuries to the knee, neck and back requiring surgical intervention.
The Challenge
The defense argued that the injuries were pre-existing, spontaneous in nature and thus unrelated to the accident.
The Result
Plaintiff's counsel secured summary judgment on liability, with the Court finding the defendants negligent and striking the comparative negligence defense, establishing that the plaintiff was entirely free from fault in causing the accident. Plaintiff’s counsel ultimately secured a $5,500,000 settlement, confronting the manufactured defenses head on and obtaining full value for a worker facing permanent injuries and the end of his career.
