The Case
The plaintiff, a temporary laborer, was standing on an A-frame ladder when it suddenly shifted, causing him to fall. He sustained severe injuries to the neck and back requiring surgery.
The Challenge
The defendants also produced a non-party former employee who testified that the plaintiff had been improperly standing on the top platform of the A-frame ladder at the time of the accident, which allegedly caused the ladder to shift and fall.
The Result
Plaintiff's counsel secured summary judgment on liability under Labor Law § 240(1) despite the testimony from the non-party witness and successfully opposed the defendants' appeal of that ruling, which remained pending as the case approached its scheduled trial date. The $6,500,000 settlement reflects counsel's commitment to the firm’s client and resilience in litigating the case until trial.
