Rideshare apps make getting around easy—until something goes wrong. If you’re searching for an Uber accident lawyer in White Plains, you may be dealing with medical bills, missed work, and confusion about whose insurance applies. Uber accidents can be complicated. The driver’s personal policy, Uber’s corporate coverage, and other drivers may all be involved.
At Shulman & Hill, our White Plains car accident lawyers help injured passengers, drivers, and pedestrians understand their rights in plain English. Since 2013, we’ve served over 26,000 clients and recovered more than $1 billion, backed by 200+ years of combined experience. We work on contingency, so there are no upfront fees.
Insurance companies—especially large corporate insurers—often focus on protecting profits first. We focus on protecting you and your family. New York, We Got You
What To Do After an Uber Accident in White Plains
Your actions in the first days can shape your claim. Seek prompt medical care, report every symptom, and follow your doctor’s orders. If you were an Uber passenger, driver, pedestrian, or cyclist, you may have coverage under New York no-fault and Uber’s policies.
- Call the police and request an accident report
- Photograph vehicles, road conditions, and injuries
- Save ride receipts, app screenshots, and driver info
- Report the crash through the Uber app without guessing about fault
- File your no-fault application within 30 days
- Contact a White Plains Uber accident attorney before giving recorded statements
Determining Liability Among Drivers, Companies, and Insurers
Multiple parties may share responsibility: the Uber driver, another motorist, a vehicle owner, a road contractor, or a manufacturer in a parts defect case. We review the crash report, witness statements, and data from the ride to identify each potential source of recovery.
New York follows pure comparative negligence. If you are found partially at fault, your damages are reduced by your percentage of fault, but you can still recover. We build the case to limit unfair fault arguments, especially in sudden stop, left-turn, or lane-change disputes that often arise in rideshare crashes.
Uber’s business model can create additional layers of coverage. Even if Uber denies that a driver was “on app,” digital records may show the true status at the moment of impact.
How Uber Accident Claims Work
Rideshare cases are different from typical car accidents because coverage depends on the driver’s status at the time of the crash:
- App off – The driver’s personal insurance applies.
- App on, waiting for a ride – Uber provides limited coverage.
- Ride accepted or passenger in car – Uber’s larger commercial policy may apply.
Understanding which policy is active matters. It can affect how much coverage is available for your injuries.
Maximizing Compensation for Medical Care and Lost Wages
Your claim may include past and future medical expenses, therapy, medical devices, and medication. Lost income can include missed shifts, reduced hours, and diminished earning capacity if you cannot return to your prior role.
When you meet the serious injury threshold, you may also pursue non-economic damages for pain, limitations, and loss of enjoyment of life. In wrongful death cases, families may pursue funeral costs, medical bills, and certain pecuniary losses under New York law.
Our personal injury lawyers in White Plains coordinate with your providers and accountants to document every loss, including projections for future care.
Evidence That Strengthens a Rideshare Injury Claim
Strong proof helps sort out fault and coverage. An experienced White Plains Uber accident lawyer can obtain the police report, traffic and doorbell videos, and witness interviews. Photos of vehicle damage and the crash scene often help reconstruct impact angles and speeds.
Uber’s electronic records can confirm when the driver accepted the trip, the route, and timestamps. Modern vehicles may store event data such as speed and braking. Phone records and telematics can help address distracted driving claims.
We move quickly to preserve this data before it is overwritten or deleted. From the start, we identify all available insurance layers and deadlines.
Our team collects medical records, consults with treating doctors, and prepares a settlement package that reflects the full scope of your losses. When Uber’s insurer or another carrier disputes fault or damages, we answer with evidence.
Frequently Overlooked Pitfalls in Rideshare Claims
Relying only on the police report can leave out key facts. Supplemental witness statements and video often change the liability picture. Avoid broad, recorded statements that invite insurers to minimize injuries or assign fault unfairly.
Do not ignore follow-up care. Gaps in treatment make it easier for an insurer to argue that your injuries are minor or unrelated. Keep a journal of symptoms, pain levels, and activity limits. Save receipts and employment records to support wage loss, overtime, and missed opportunities.
If multiple insurers are involved—your PIP carrier, Uber’s carrier, and another driver’s insurer—communications can become tangled. We coordinate benefits so bills get paid correctly and in the right order, while we pursue the full value of your injury claim.
