Who Is Liable After an Uber Accident in New York
Liability in an Uber accident depends on the circumstances of the crash and the status of the driver at the time of the collision. Our personal injury lawyer in Scarsdale can help you determine which parties may be responsible and how to pursue claims against each of them.
The Uber driver may be personally liable if their negligence caused the accident. Uber itself may bear responsibility depending on the driver’s status in the app at the time of the crash. In some cases, another driver, a vehicle manufacturer, or a government entity responsible for road maintenance may also share liability.
Identifying all responsible parties early in the process is critical to building the strongest possible claim and avoiding gaps in your recovery.
How Uber Accidents Happen
Uber drivers spend long hours on the road, often navigating unfamiliar routes while managing the app, accepting rides, and dealing with passenger requests. This combination of distractions and demands creates real risks for everyone on the road.
Common causes of Uber accidents in the Scarsdale area include:
- Distracted driving: Uber drivers frequently interact with the app while driving, taking their attention away from the road at critical moments.
- Driver fatigue: Many Uber drivers work long shifts or drive after a full day of other work, increasing the risk of impaired reaction times and poor decision-making.
- Speeding and aggressive driving: Pressure to complete more rides in less time can lead to unsafe driving behaviors on Scarsdale roads and surrounding highways.
- Failure to yield: Unfamiliarity with local roads and intersections can lead to dangerous errors, particularly in residential areas.
Understanding how your accident happened is essential to identifying who bears responsibility and what insurance coverage applies.
How Uber’s Insurance Coverage Actually Works
Uber provides different levels of insurance coverage depending on what the driver was doing at the time of the accident. Understanding these tiers is essential to knowing what compensation may be available to you.
When the Uber app is off, only the driver’s personal insurance applies. When the driver has the app on but has not yet accepted a ride, Uber provides limited liability coverage. Once a ride is accepted and through the completion of the trip, Uber’s full $1 million liability policy is in effect.
These distinctions matter enormously in practice. Insurers will look closely at the driver’s app status at the moment of the crash, and disputes over coverage tiers are common. Our Scarsdale Uber accident attorneys know how to investigate these details and push back when insurers attempt to apply a lower coverage tier than the facts support.
Why Uber Accident Claims Are More Complicated Than They Seem
Uber accident cases involve layers of complexity that standard car accident claims do not. Multiple insurance policies may apply, and each insurer has an interest in minimizing its share of the payout. Uber’s own legal and claims teams are experienced at protecting the company’s financial exposure.
Gathering the right evidence quickly is critical. App data, GPS records, driver history, and trip logs can all play a role in establishing what happened and who is responsible. This type of evidence can be difficult to obtain without legal intervention, and it may not be preserved indefinitely.
Shulman & Hill conducts thorough in-house investigations to secure the evidence your case needs before it disappears. We have the experience and resources to take on large rideshare companies and their insurers on your behalf.

What Your Uber Accident Claim May Be Worth
The value of an Uber accident claim depends on the severity of your injuries, the impact on your life, and the insurance coverage available. Because Uber’s full $1 million policy can apply when a ride is active, serious injury claims in rideshare cases can result in significant recoveries.
Damages may include medical expenses, future care costs, lost income, reduced earning capacity, pain and suffering, and in cases involving serious or permanent injuries, compensation for lasting disability or disfigurement.
Shulman & Hill has recovered over $1 billion for injured New Yorkers, and we know how to build cases that reflect the true value of what our clients have lost. No two cases are alike, and the best way to understand what your claim may be worth is to speak with a lawyer as soon as possible after your accident.
