Who Can Be Held Liable After a Taxi Accident in New York
Liability in a taxi accident case can extend beyond the driver to include the taxi company, the vehicle owner, and in some cases a maintenance provider or government entity. Our personal injury lawyer in Scarsdale will examine every aspect of your case to make sure all responsible parties are identified and pursued.
The taxi driver may be personally liable if their negligence caused the accident. The taxi company may share responsibility if it failed to properly screen, train, or supervise the driver, or if it allowed a poorly maintained vehicle to remain in service. If a defective vehicle component contributed to the crash, the manufacturer may also bear liability.
How Taxi Accidents Happen in Scarsdale
Taxi drivers spend more time on the road than almost any other type of driver, and that exposure creates real risks for passengers, pedestrians, and other motorists. Understanding the common causes of taxi accidents helps establish the basis for a strong liability claim.
Common causes of taxi accidents in the Scarsdale area include:
- Driver fatigue: Taxi drivers often work long shifts with little rest, which can impair reaction times and judgment on the road.
- Distracted driving: Managing dispatch communications, GPS navigation, and passenger interactions can pull a driver’s attention away from the road at critical moments.
- Aggressive driving: Pressure to complete more fares in less time can lead to speeding, unsafe lane changes, and failure to yield.
- Poor vehicle maintenance: Taxi fleets that are not properly maintained may have brake failures, tire blowouts, or other mechanical issues that contribute to accidents.
Identifying the cause of your accident is the first step toward determining who is responsible and what compensation may be available to you.
How Taxi Insurance Coverage Differs From Rideshare Coverage
Unlike rideshare drivers, taxi drivers in New York are required to carry commercial auto insurance as a condition of their operating license. New York City taxis are regulated by the Taxi and Limousine Commission and must carry minimum liability coverage set by the TLC.
For-hire vehicles operating outside the city may be subject to different requirements depending on their licensing jurisdiction. In either case, the commercial insurance requirements for taxis are generally more straightforward than the tiered coverage structure that applies to rideshare companies.
This does not mean recovering compensation is simple. Taxi companies and their insurers still fight hard to minimize payouts, and disputes over fault and damages are common. Our team knows how to cut through those disputes and pursue the full compensation you may be entitled to.
What to Do After a Taxi Accident in Scarsdale
The steps you take immediately after a taxi accident can have a lasting impact on your health and your legal claim. Acting carefully and promptly helps protect both.
If you are involved in a taxi accident in Scarsdale, consider taking the following steps:
- Seek medical attention right away: Even if your injuries seem minor, get evaluated as soon as possible. Some injuries do not produce obvious symptoms immediately.
- Document the scene: Take photographs of the vehicles, the road conditions, any visible injuries, and the taxi’s license plate and medallion number.
- Get the driver’s information: Record the driver’s name, license number, and insurance information, as well as the taxi company’s name.
- Request a copy of the police report: A police report creates an official record of the accident and can be valuable evidence in your claim.
- Contact a lawyer before speaking with insurers: Insurance adjusters may contact you quickly after the accident, and anything you say can be used to minimize your claim.
Taking these steps early gives your case the strongest possible foundation.

What Your Taxi Accident Claim May Be Worth
The value of a taxi accident claim depends on the severity of your injuries, the circumstances of the accident, and the insurance coverage available. Because taxis are required to carry commercial insurance, there may be more coverage available than in a standard car accident case.
Damages in a taxi accident case may include medical expenses, future treatment costs, lost income, reduced earning capacity, pain and suffering, and compensation for permanent injury or disfigurement.
Shulman & Hill has recovered over $1 billion for injured New Yorkers, and we know how to build cases that account for the full scope of what our clients have lost after a taxi accident in Scarsdale.
