Common Taxi Accident Scenarios
Taxi collisions can happen in many ways: sudden stops that throw you forward, sideswipes while merging, rear-end impacts, and left-turn crashes at busy intersections. Pedestrians and cyclists are also at risk when a cab pulls curbside without signaling.
Some cases involve multi-vehicle chain reactions on roads like Jericho Turnpike or NY-110, while others stem from fatigue, distracted driving, or poor vehicle maintenance. Each scenario raises different questions about fault, insurance, and available damages. Our personal injury lawyer in Huntington can help you through the legal process.
Who Is Liable After a Cab Crash in Huntington?
Multiple parties may share legal responsibility. The taxi driver can be liable for speeding, distraction, or violating right-of-way rules. The vehicle owner or taxi company may be on the hook for negligent entrustment, hiring, supervision, or unsafe maintenance practices.
Another motorist may bear fault if they cut off the cab, ran a light, or followed too closely. In limited situations, a municipality or contractor could be implicated for hazardous roadway conditions. New York’s comparative fault rules can reduce but not eliminate your recovery when fault is shared, so properly allocating responsibility matters.
Damages You Can Seek Under New York Law
Your claim can include both economic and non-economic losses. Economic damages cover medical expenses, rehabilitation, prescriptions, mobility aids, lost wages, and reduced earning capacity. Property damage for your phone, bike, or vehicle may also be included.
If you meet the serious injury threshold, you can pursue pain and suffering, loss of enjoyment of life, and related intangible harms from the at-fault party. Families in fatal cases may bring a wrongful death action for final expenses and economic losses, subject to New York’s rules on who may file. Our taxi accident lawyers in Huntington can help you recover compensation.
Our Taxi Accident Lawyer in Huntington Can Explain Insurance Rules
No-fault benefits are time-sensitive, and the application must be completed promptly to preserve eligibility. Commercial taxi policies can be different from personal auto policies, with higher limits and special endorsements. Some for-hire vehicles carry optional medical payments or additional no-fault benefits.
If the at-fault driver is uninsured or underinsured, uninsured motorist or underinsured motorist (UM/UIM) coverage may help fill the gap. New York law can also hold vehicle owners responsible for crashes caused by drivers who had permission to use the cab. We identify every available policy and coordinate claims to pursue full compensation.
Evidence That Strengthens Your Case in Huntington
Taxi cases often generate unique records that help prove fault and damages. Useful evidence includes police reports, witness statements, photos and videos, medical documentation, repair invoices, and employment records showing missed work.
From the taxi side, trip sheets, dispatch logs, GPS data, electronic logging, maintenance records, and dashcam footage can be important.
Our taxi accident lawyers in Huntington can send preservation letters to cab companies and insurers to prevent deletion of relevant data. We also collect footage from nearby businesses or traffic cameras when available and consult qualified experts to reconstruct the crash or support medical causation.
What if the Taxi’s Dashcam Footage Is Missing?
Missing or overwritten video does not end your claim. We can rely on other sources like passenger phone videos, third-party dashcams, black-box data, and eyewitnesses.
If a company discards material it should have kept after notice, courts may permit an adverse inference that the lost evidence would have been unfavorable to that party.
Timelines and Filing Deadlines in New York
Deadlines arrive quickly. The no-fault application typically must be filed within 30 days of the crash, and medical providers face billing timelines as well. Most personal injury lawsuits in New York must be filed within three years, while wrongful death actions generally have a shorter period.
If a public entity is involved, you may need to serve a Notice of Claim within 90 days, and then file suit within a shorter statute of limitations. Exceptions and tolls exist, but waiting can jeopardize your rights. We track every deadline and file on time.
Dealing With the Taxi Company and Insurers
Insurers and claim administrators often seek recorded statements, medical authorizations, or independent medical exams early on. Quick settlement offers may undervalue your future care, wage loss, or pain and suffering. We handle communications, prepare you for any statements or examinations, and push back against tactics that minimize your claim.
We also address health insurance liens, workers’ compensation liens, and coordination with PIP, so you are not surprised by reimbursement demands later. Our goal is to position your case for a fair settlement or prepare it for court if needed.
