Motorcycle Accident Claims We Handle
Every crash is different, but we regularly assist with:
- Left-turn collisions and failure-to-yield crashes
- Rear-end and unsafe lane change impacts
- Dooring incidents and sideswipe collisions
- Drunk or drug-impaired driving crashes
- Roadway hazard or defective design claims
- Hit-and-run and uninsured motorist cases
We also address unique rider issues such as helmet use, visibility, and bias against motorcyclists. Credible evidence and clear medical documentation help counter unfair assumptions.
Who Pays for Your Losses Under New York Law
New York’s no-fault rules do not cover motorcyclists. Unlike car occupants, riders typically do not receive PIP benefits, so your medical bills and lost wages are not paid automatically.
You can pursue the at-fault driver’s liability coverage without the “serious injury” threshold that applies to cars. You may also claim under your own uninsured/underinsured motorist (UM/UIM) policy if the other driver fled or lacks sufficient coverage.
New York follows pure comparative negligence. If you are found partly at fault, your recovery is reduced by your percentage of fault, not barred entirely.
Evidence That Moves the Needle in a Claim
Winning a fair settlement or verdict depends on credible, organized proof. Begin collecting and preserving evidence right away, because skid marks fade and vehicles get repaired quickly.
Your case may draw on independent witness statements, the police report, photos, helmet or gear damage, medical imaging, and testimony from treating providers. We often hire reconstruction and human factors experts to explain speed, visibility, and reaction times.
Digital Footprints and Data Sources
Modern cases often involve data. This can include vehicle event data recorders (EDRs), GPS history, phone records, dashcam footage, nearby business surveillance, traffic cameras, and ride-tracking apps. Prompt preservation letters help secure this material before it’s lost.
Damages You Can Seek for Rider Injuries
A successful claim can cover both economic and non-economic losses. Economic damages include hospital bills, surgery, physical therapy, future medical needs, and lost income or diminished earning capacity.
You can also pursue payment for pain and suffering, loss of enjoyment of life, scarring, disfigurement, and loss of consortium. If a loved one passed away, wrongful death damages may include funeral costs and certain financial losses to the family.
Our Babylon motorcycle accident lawyers work with medical and vocational experts to quantify long-term effects. This helps present a clear picture of your needs to the insurer or a jury.
Dealing With Adjusters and Lowball Offers
Insurers often reach out quickly with friendly questions that are later used to reduce claims. You are not required to give a recorded statement to the other driver’s insurer.
Early offers rarely reflect the full value of a motorcycle crash case. They may omit future care, understate pain and limitations, or overlook permanent impairment. Let a motorcycle crash lawyer in Babylon handle communications so you don’t leave money on the table.
If negotiations stall, we prepare for litigation. Filing suit can increase pressure and provide tools like subpoenas and depositions to strengthen your case.
Timelines, Deadlines, and Your Right to Sue
Most New York personal injury claims must be filed within three years. Wrongful death suits usually have a two-year limit. Some claims against government entities require a Notice of Claim within 90 days, followed by shortened suit deadlines.
You must file an MV-104 with the DMV within 10 days if the crash caused injury, death, or property damage above the statutory threshold. Missing deadlines can bar recovery, so acting promptly is wise.
We track every date and handle service of process, discovery schedules, and court appearances so your case moves forward on time.
Immediate Steps After a Motorcycle Crash
Your health comes first. Get medical care immediately, even if you feel okay. Adrenaline can mask injuries, and prompt records connect your injuries to the crash.
Call the police to report the collision and request an accident report. Exchange information with drivers and witnesses, and take photos or video of vehicles, roadway markings, debris, and your gear.
Avoid giving recorded statements to insurers before legal guidance. Early comments can be used to reduce your payout. Contact a Babylon motorcycle accident attorney as soon as you can.
What to Expect When You Hire Our Team
We explain your options, expected timelines, and likely case value ranges based on evidence and coverage. You will know how settlement talks work, and when filing a lawsuit may help.
We communicate regularly about medical updates, negotiations, and next steps. If a trial becomes necessary, we prepare you for testimony and collaborate with experts to present your case clearly.
You owe no attorney’s fees unless we recover compensation. Costs are discussed upfront so you can make informed choices.
Safety Laws and Their Impact on Your Claim
New York requires DOT-compliant helmets for riders and passengers. Compliance can reduce injury severity and counter defense arguments, though the lack of a helmet does not excuse another driver’s negligence.
Motorcycle endorsements, equipment requirements, and insurance rules can all affect your case. We analyze the police report and citations but focus on the primary cause of the crash and the injuries it produced.
If a defective part or recalled component played a role, we may pursue a product liability claim against the manufacturer or distributor.
