A lawsuit against the New York City Transit Authority or another covered authority may also face a shorter limitations period. This deadline is often one year and 90 days, depending on who the defendant is and applicable law.
These deadlines are separate from the no-fault insurance filing deadline. Missing a notice-of-claim deadline can prevent you from pursuing compensation in many cases, although limited exceptions may be available. New York’s comparative negligence rules changed in 2026 for motor vehicle personal injury actions commenced on or after May 26, 2026.
