An Uber injury claim can involve several insurers, each covering a different stage of the driver’s trip. At Shulman & Hill Injury Lawyers, our Uber accident lawyers in Hudson, NY, investigate the collision and the driver’s app activity to determine who is responsible and which coverage applies.
Our team has over 200 years of combined experience representing injured New Yorkers. We bring that experience to claims involving rideshare passengers, drivers, pedestrians, and cyclists.

Who Can Be Held Responsible for an Uber Accident?
Our Hudson personal injury lawyers establish liability by examining the driving decisions that led to the collision. An Uber driver may be liable for speeding, failing to yield, following too closely, or looking at a phone instead of the road. Another motorist may also bear responsibility.
Pickup and dropoff locations require particular attention. Hudson Amtrak station on South Front Street is a common place to arrange a ride. For a collision during a station pickup, we examine where the vehicle stopped, how it entered traffic, and whether the driver checked for pedestrians and approaching vehicles.
Depending on the evidence, we may pursue claims involving a vehicle owner or another legally responsible party. Coverage under an Uber policy does not automatically establish that Uber itself was negligent. We evaluate insurance coverage and legal responsibility separately.
Uber Insurance Coverage for Hudson Accidents
For qualifying rideshare trips originating in New York but outside New York City, insurance requirements vary based on the driver’s app status.
Our Uber accident attorneys in Hudson review trip records and policy documents to identify the coverage available for your claim. Trips originating in New York City follow different rules, even if the collision occurs in Hudson.
When the Driver Is Offline
When the driver is not using the app for rideshare work, the vehicle’s standard auto insurance generally applies under its terms. The fact that the driver sometimes works for Uber does not make every collision a rideshare insurance claim.
When the Driver Is Waiting for a Request
While the driver is logged in but has not accepted a trip, New York requires rideshare liability coverage of at least:
- $75,000 for bodily injury or death of one person.
- $150,000 for bodily injury or death of two or more people per accident.
- $25,000 for damage to another person’s property.
Required coverage also includes no-fault and uninsured motorist protection. The driver’s insurance, the rideshare company’s group policy, or a combination may satisfy these requirements.
After the Driver Accepts a Trip
Once the driver accepts a request, required liability coverage increases to at least $1.25 million per accident. This stage includes travel to collect the passenger and continues until the last requesting passenger exits. Required coverage also includes $1.25 million in supplementary uninsured/underinsured motorist protection and no-fault benefits.
These limits describe available insurance protection, not the amount you will receive. Payment depends on liability, your injuries, policy terms, and other applicable legal requirements.
How Our Hudson Uber Accident Attorneys Build Your Claim
At Shulman & Hill, our Hudson Uber accident attorneys use in-house investigations to connect the collision, the available insurance, and your losses. We handle communications with insurers and explain what additional evidence is needed as your claim develops.
Our work includes:
- Investigating the collision: We review police reports, photographs, witness accounts, and available video.
- Confirming trip status: We seek app records and timestamps showing whether the driver was waiting, collecting a passenger, or completing a ride.
- Preserving evidence: We request relevant recordings and electronic records before they are deleted.
- Documenting your injuries: We review treatment records, medical findings, work restrictions, and recommendations for future care.
- Assessing settlement offers: We compare proposed payments with your supported losses and explain the rights a release would end.
- Preparing for court: We file suit when appropriate and obtain further evidence through the litigation process.
You can help by saving your trip receipt, driver information, messages, and insurer correspondence. A screenshot showing an accepted ride may help resolve a coverage dispute even when you had not yet entered the vehicle.
Medical Bills, Lost Income, and Other Compensation
We assess both the benefits available regardless of fault and the damages you can seek from a responsible party. Your role in the accident and the vehicles involved help determine which insurer should receive your claim.
No-Fault Benefits
New York’s basic no-fault coverage generally provides up to $50,000 per eligible person for covered medical expenses, a portion of lost earnings, and certain other reasonable expenses, subject to statutory limits. These benefits do not compensate you for pain and suffering.
If you were driving for Uber, we also review whether workers’ compensation benefits are available through the New York Black Car Fund. Our personal injury and workers’ compensation teams can coordinate related claims.
Compensation From a Responsible Party
A liability claim may seek qualifying economic losses beyond New York’s basic economic loss limits. Depending on the evidence, these may include additional medical costs, future care expenses, and reduced earning ability. An unpaid bill does not automatically qualify simply because a no-fault insurer declined payment.
Pain and suffering claims generally require a legally defined serious injury. Qualifying categories include fractures, significant disfigurement, and certain permanent or significant limitations. We use medical evidence to assess whether your injuries meet the applicable standard.
How Shared Fault Affects an Uber Injury Claim
New York changed its comparative negligence rules for motor vehicle personal injury actions in 2026. For actions subject to Insurance Law Article 51 commenced on or after May 26, 2026, recovery is barred if your fault exceeds the combined fault of the defendants from whom you seek compensation.
When recovery is permitted, your damages are reduced by your share of responsibility. We review the applicable law and challenge unsupported fault allegations using vehicle movements, traffic rules, witness accounts, and other evidence. An insurer’s initial assignment of blame does not decide your case.
Deadlines for Uber Accident Claims in New York
Different deadlines apply to insurance benefits and lawsuits. Reporting the accident through Uber does not necessarily satisfy an insurer’s notice requirements.
- No–fault notice: Written notice generally must be delivered to the appropriate insurer within 30 days of the accident, subject to a limited exception for a justified delay.
- Negligence lawsuits: Most personal injury negligence claims must be filed within 3 years of the accident.
- Government claims: A claim against a municipality may require a notice of claim within 90 days and a shorter period for filing a lawsuit.
Separate deadlines apply to the submission of medical bills and lost-income documentation. We identify the requirements for your claim early, rather than waiting until treatment or settlement discussions are complete.
