Steps to Take After a Hit and Run
Your actions in the first hours and days can shape the outcome of your case. Small steps add up and help preserve proof that might otherwise disappear.
- Call 911 and get medical care right away.
- Report the crash to police and request the report number.
- Photograph the scene, damage, debris, and any skid marks.
- Ask nearby businesses or homes about cameras and save video quickly.
- Get names and numbers for witnesses and first responders.
- Notify your insurer the same day and request UM claim information.
Even if you feel okay, see a doctor and follow the treatment plan. Gaps in care can weaken the link between the crash and your injuries. After a hit and run, call an Oyster Bay personal injury lawyer.
Proving Fault and Damages With Limited Information
You might think a hit and run leaves you with no way to prove what happened. In practice, we often build strong cases with circumstantial proof. Vehicle damage patterns, scene photographs, medical findings, and witness accounts can show the mechanism of injury and support liability.
We also look beyond the scene. License plate readers, traffic cameras, toll data, and nearby surveillance can identify vehicles that match damage and timing. When needed, we bring in accident reconstruction and biomechanics experts to connect the dots.
On the damages side, we document every part of your recovery. Diagnostic records, specialist notes, therapy logs, and employer confirmations help us quantify losses and present them clearly to an adjuster, arbitrator, or jury.
What Compensation May Be Available
Your recovery depends on policy limits, the severity of your injuries, and whether the driver is identified. Even with UM-only claims, you may recover meaningful compensation.
Common categories include pain and suffering, medical bills not covered by No-Fault, full wage loss and diminished earning capacity, out-of-pocket expenses, and future care costs. If your injuries meet New York’s serious injury threshold, non-economic damages are on the table.
Property damage typically proceeds through collision coverage or the liable driver’s insurer once identified. Our hit and run lawyers in Oyster Bay coordinate these pieces so your bodily injury case is not delayed.
How Shulman & Hill Builds Your Case
We start with a focused intake to capture what you remember, the injuries you feel, and any vehicles or people you noticed. Then we obtain the police report, 911 audio, and dispatch logs to find witness leads and timelines.
From there, we gather medical records, wage proof, and imaging. We request video from local businesses, submit preservation letters, and inspect your vehicle.
When we present your claim, we package the evidence in a clear format and negotiate firmly with the carrier. If settlement talks stall, we pursue arbitration or litigation to move the case forward.
Securing Witnesses and Video in a Hit and Run Case
Witnesses can make or break a hit and run claim. We contact them quickly while memories are fresh and secure written or recorded statements. Even small details like a partial plate or bumper sticker can matter.
Video is equally valuable. Corner stores, bus depots, parking lots, and private homes often capture the route a fleeing driver took. We canvass the area, deliver preservation notices, and retrieve native files to maintain quality.
If needed, we engage investigators to track down additional sources, including rideshare logs, delivery vehicles, and municipal cameras, subject to proper requests.
When the Driver Is Identified Later
Sometimes the driver surfaces weeks or months after the crash. If that happens, we pivot and pursue a bodily injury claim against that driver and their insurer while keeping your UM claim in place as a fallback. This protects you if the at-fault policy has low limits or coverage disputes.
We compare the value of the case to the available limits and explore Supplementary Uninsured/Underinsured Motorist (SUM) coverage. SUM can fill the gap when the at-fault policy is not enough. Proper notice and consent procedures help avoid coverage issues.
If the at-fault carrier denies liability, we proceed with suit and use discovery to obtain phone records, vehicle repair histories, and other evidence that can tie the driver to the collision.
What to Expect From the Legal Process
Most cases begin with claim notices, document collection, and early benefit coordination. Next comes a liability and damages package to the carrier with a settlement proposal backed by evidence. If we cannot resolve it, we file for UM arbitration or commence a lawsuit.
Discovery follows, including depositions and independent medical exams. Throughout, we update you regularly and discuss settlement offers and risks candidly. If needed, we take the case to a hearing or trial and present your story with the proof we have built.
While timelines vary, early action, steady documentation, and strong advocacy usually shorten the path to a result. We aim to put you in a position to make informed choices at each step.
Evidence We Gather to Strengthen Your Claim
Every claim benefits from clear, organized proof. We tailor our approach to your case and act quickly before evidence fades.
- Police reports, 911 recordings, and dispatch data
- Scene photos, debris fields, and vehicle inspections
- Medical records, imaging, and provider opinions
- Employer wage records and disability notes
- Surveillance and traffic camera video
- Expert analyses on accident reconstruction or biomechanics
Each item supports a part of your claim—how the crash happened, how you were injured, and how your life has changed. Together they create leverage in negotiations and at a hearing or trial.
