Why Hit-and-Run Accident Claims Are Different
A regular car accident claim often starts with both drivers exchanging insurance information. In a hit-and-run case, that step never happens. Instead, the case may depend on physical evidence, witness accounts, camera footage, police work, and the language in your own insurance policy.
Insurance companies may question parts of the claim, including:
- Whether another vehicle caused the crash.
- Whether there was physical contact with the fleeing vehicle.
- Whether your injuries came from this collision.
- Whether you reported the crash on time.
- Whether your policy provides uninsured motorist benefits.
- Whether your medical records support the damages claimed.
Our Bronx personal injury lawyers know how these disputes develop. Shulman & Hill conducts in-depth in-house investigations so we can build a clear record of what happened, who may be responsible, and which coverage should respond.
Who Our Bronx Hit-and-Run Lawyers Represent
We represent people injured in many types of hit-and-run claims, including:
- Drivers struck by a fleeing motorist.
- Passengers injured in a vehicle that was hit.
- Pedestrians struck in crosswalks or along the road.
- Cyclists hit or forced off their bikes.
- Delivery workers injured while driving, biking, or walking.
- Rideshare passengers hurt in hit-and-run crashes.
- Families pursuing wrongful death claims after fatal collisions.
We also review whether more than one policy may apply. Depending on the facts, coverage may come from your own auto policy, a household policy, the vehicle you occupied, or another available insurance source.
Compensation Available After a Bronx Hit-and-Run Accident
The value of a hit-and-run claim depends on your injuries, the available insurance coverage, and how the crash has changed your daily life.
A claim may include compensation for the following:
- Emergency care
- Hospital treatment
- Surgery
- Physical therapy and rehabilitation
- Follow-up appointments
- Medication and medical equipment
- Lost wages
- Reduced ability to work
- Pain and suffering
- Loss of enjoyment of life
- Long-term disability or permanent injury
- Wrongful death damages for surviving family members
New York law also has specific rules for injury claims arising from motor vehicle crashes, including no-fault benefits and serious injury requirements for certain damages. We review those issues early so you understand what can be claimed and what proof is needed.
Insurance Coverage That May Apply in a Hit-and-Run Case
Many hit-and-run injury claims are paid through the injured person’s own insurance coverage, not the fleeing driver’s insurer. That surprises many clients, but it is often how these cases move forward when the at-fault driver remains unidentified.
No-Fault Benefits
New York no-fault coverage may pay certain economic losses after a motor vehicle crash, regardless of who caused the collision. These benefits may include medical bills, a portion of lost earnings, and certain related expenses up to policy limits.
No-fault claims have strict paperwork and timing requirements. Missing a deadline can give the insurer a reason to deny benefits.
Uninsured Motorist Coverage
Uninsured motorist coverage may apply when a hit-and-run driver cannot be identified. This coverage can be especially significant when someone suffered a serious injury and needs to pursue damages beyond basic no-fault benefits.
These claims often involve close review of the policy, the crash report, medical records, and whether the accident meets policy requirements. Our Bronx hit and run lawyers handle those communications and push back when insurers take an unfair position.
Deadlines That Can Affect Your Bronx Hit-and-Run Claim
New York hit-and-run claims can involve more than one deadline. For most personal injury lawsuits after a car accident, New York gives you three years from the date of the crash to file a lawsuit. If the crash caused a death, the deadline for a wrongful death claim is generally two years from the date of death.
Insurance deadlines can be much shorter. In many New York no-fault claims, written notice must be submitted to the no-fault insurer within 30 days of the accident. Medical bills are generally due within 45 days, and lost wage claims are generally due within 90 days.
You should speak with a lawyer right away if:
- You have not filed a police report.
- You have not reported the crash to your insurer.
- The insurance company is asking for a recorded statement.
- You received denial paperwork.
- A city, state, police, sanitation, transit, or other public vehicle may have been involved.
- The crash happened near government property or a public work site.
Claims involving New York City, the State of New York, or another public entity can have shorter rules. In many municipal claims, a notice of claim must be served within 90 days. Lawsuits against certain public entities may also have a shorter filing period than ordinary injury cases.
Our hit and run lawyers in the Bronx can identify the deadlines that apply and take the steps needed to protect your claim.
