Understanding Slip and Fall Accidents
Slip and falls are a type of claim under premises liability law. Victims may be entitled to compensation from the property owner for slip and fall accidents on the property owner’s premises.
Slip and fall accidents have several causes, such as wet floors, uneven sidewalks, or elevators that don’t stop flush with the floor. If you slipped, tripped, or fell on someone else’s property, you may have a claim for damages if you can show that their negligent actions caused your injuries and other losses.
How To Prove Liability in a Slip and Fall Case
Under New York law, property owners, businesses, and anyone in control of a premises must keep it reasonably safe. That means inspecting for hazards, fixing dangers, and warning people when risks exist. When they fail to meet their duty to keep the property safe, people get hurt—which can be grounds for a claim. With the right evidence, you can fight for compensation through an insurance claim, lawsuit, or both.
Key evidence includes:
- Photos of the accident scene and surrounding area
- Surveillance footage
- Eyewitness statements
- Weather reports showing when storms ended
- Maintenance records
At Shulman & Hill, our Queens injury attorneys don’t waste time. We move fast to secure evidence, build solid cases, and, when necessary, take your fight to court.

Compensation for Slip and Fall Victims
Slip and fall accidents can cause physical, emotional, and financial harm. Damages available for compensation in slip and fall claims include:
- Medical bills and future medical costs
- Lost wages and reduced earning capacity
- Home nursing and other care
- Pain and suffering
- Emotional distress
- Funeral expenses, loss of benefits and support, and other damages in a slip and fall wrongful death claim
Factors that may affect the amount of compensation you receive include the severity of your injuries, the long-term impact of your accident on your work and home life, your emotional trauma, and the strength of your evidence.
How the Severity of Slip and Fall Injuries Affects Your Case
The severity of your injuries affects more than just your recovery. It can impact your finances, future, and overall quality of life. Serious injuries may require months of rehabilitation, time off work, or even lead to permanent disability. Some slip and fall injuries have lasting consequences, including:
- Broken bones that may require surgery, physical therapy, and extended time off work
- Traumatic brain injuries that can cause memory loss, cognitive issues, and expensive ongoing care
- Spinal cord injuries that carry the risk of permanent disability, mobility challenges, and lost income
These injuries can take a heavy toll, both financially and emotionally. Our Queens slip and fall lawyers will calculate the full extent of your short- and long-term damages, ensuring you get the compensation you need while you focus on healing.
How Accident Location Can Impact Your Case
Where your accident happened plays a key role in determining who is liable, what evidence to gather, and the best legal strategy to use. Slip and fall accidents can happen anywhere, including:
- Businesses: Grocery stores, malls, and restaurants must maintain safe premises. Security footage and maintenance logs can help prove negligence.
- Apartment buildings and rental properties: Management companies or landlords must inspect premises and fix hazards. Lease agreements may show who is responsible, and past complaints may indicate negligence.
- Sidewalks and public spaces: If not properly maintained, it can lead to liability for private owners or the city government. Strict deadlines apply for government claims.
- Workplace and construction site: These accidents may result in workers’ compensation, but third-party claims can increase compensation.
- Parking lots and stairwells: Poor lighting, potholes, or broken railings can indicate negligence by the property owner or a company they hired to maintain the premises.
At Shulman & Hill, we know where to look, who to hold accountable, and how to build a case that gets results. If someone’s negligence put you in this position, we’ll hold them responsible for your injuries and other losses.

How Long Do You Have to File a Claim? (Statute of Limitations)
If your slip and fall happened on private property, the New York personal injury statute of limitations gives you three years from your accident date to file a claim. If your loved one died as a result of a slip and fall, you must file your wrongful death claim within two years of the date of death.
If your slip and fall happened on government property, you must file a notice of claim with the government entity within 90 days. If you don’t receive a satisfactory settlement offer, you have one year and 90 days to file a formal lawsuit.
Take action quickly to preserve your rights. If you fail to file on time, a judge will likely dismiss your claim, and you may miss your chance to get the compensation you deserve.
