The incident occurred on March 15, 2017, when our client slipped on a patch of ice that had formed after a snowstorm the previous day. The ice was a result of melted snow that had refrozen overnight—an entirely foreseeable hazard that the property owner failed to address. To support this, Shulman & Hill retained an expert meteorologist, who confirmed that the ice was consistent with refreezing conditions that the defendants should have anticipated and mitigated.

As a result of the fall, our client sustained multiple severe injuries, including:

  • A complete tear of the supraspinatus tendon in her left shoulder
  • Tears in the glenoid labrum and glenohumeral ligament
  • Meniscal tears in her left knee
  • Cervical and lumbar disc herniations
  • And other related orthopedic injuries

Her path to recovery required extensive medical intervention. She underwent arthroscopic surgeries on her shoulder and knees, received epidural injections for pain management, and ultimately underwent knee replacement surgeries. Despite the significant medical evidence, the defense attempted to downplay her injuries, with their expert characterizing them as “soft tissue injuries” that had supposedly resolved.

The primary insurance carrier paid $1 million, and an excess insurer contributed an additional $600,000 to bring the case to resolution.
